Who is Required to Comply?

Florida law requires public lodging establishments that are three stories or higher to certify that all balconies, platforms, stairways, and railings have been inspected by a competent professional and are safe, secure, and free of defects. The Certificate of Balcony Inspection (DBPR HR-7020) is valid for three (3) years; a new certificate must be filed before the prior one expires.

If condominium units are operated as public lodging (e.g., hotel/short-term rental operation) and the building is 3+ stories, HR-7020 requirements can apply. Private, nonlodging condos do not file HR-7020, but they may have Milestone and SIRS obligations under separate statutes.
